GENERAL TERMS AND CONDITIONS – Bharatvaas Travels
These General Terms and Conditions apply to all travel services provided by Bharatvaas Travels, based in Jaipur, India (“the Organizer”), including B2B group tours, customized journeys, and—where applicable—direct-to-consumer (B2C) travel services.
1. Definitions
- Organizer: Bharatvaas Travels, the company organizing and offering the services.
- Client: Any person, company, agent, or reseller who books services with the Organizer.
- Service: Any travel-related offering such as tours, transportation, accommodation, guides, or experiences.
- Partner Entity: A local European or international travel brand (e.g., Heart of India Travel) through which B2C services may be coordinated.
2. Applicability
These terms apply to all contracts concluded between the Organizer and the Client (B2B or B2C), unless otherwise agreed in writing. Where B2C clients book via a European partner, the conditions of both entities may apply jointly.
3. Booking & Confirmation
- A booking is confirmed once the Organizer receives written confirmation (email accepted) and initial payment.
- The Client is responsible for providing accurate traveler information and respecting local travel conditions.
4. Prices & Payment
- Prices are quoted in Indian Rupees (INR) or Euros (EUR), as agreed.
- Payment schedules and currency details will be outlined in each agreement.
- Late payments may lead to cancellation of services or withheld confirmations.
5. Cancellation Policy
Cancellations must be submitted in writing. Charges apply depending on cancellation timing:
- ≥ 60 days: 15% of total cost
- 30–59 days: 35%
- 15–29 days: 60%
- < 15 days: 100% Refunds exclude non-recoverable or prepaid third-party costs.
6. Changes & Amendments
The Organizer may make adjustments due to force majeure or local conditions. Client-requested changes are subject to availability and additional costs.
7. Liability
- Bharatvaas Travels is not liable for disruptions caused by third-party providers (e.g., hotels, airlines).
- All participation is at the traveler’s own risk.
- Clients are strongly advised to obtain personal travel and medical insurance.
8. Force Majeure
The Organizer is not liable for delay or loss caused by natural disasters, strikes, epidemics, or other events beyond its control.
9. Passport, Visa, and Health Requirements
The Client is responsible for fulfilling all entry and health requirements. Bharatvaas may offer guidance but is not liable for denied entry or related costs.
10. Complaints
Complaints must be reported to the Organizer during the journey. Formal complaints must be submitted in writing within 14 days of trip completion.
11. Jurisdiction & Applicable Law
All agreements are governed by Indian law. Disputes shall be submitted to the competent court in Jaipur, Rajasthan, India, unless otherwise agreed.
12. Financial Responsibility
Bharatvaas Travels operates under Indian law and takes reasonable steps to protect client payments. For European clients booking via an EU-based B2C partner (e.g., Heart of India Travel), local consumer protections and financial guarantees may apply
13. B2B Specific Terms
- B2B clients are responsible for reselling services under their own branding.
- They handle their own client communication, marketing, and payments.
- Commission structures, exclusivity, and minimum group size agreements are defined per contract.
- The Organizer reserves the right to review partner eligibility and terminate collaboration if standards are not met.
14. Intellectual Property
All materials (texts, images, itineraries) shared by the Organizer remain its intellectual property unless stated otherwise. Reuse or distribution without written consent is prohibited.
15. Mixed B2B–B2C Operation
Bharatvaas Travels may operate in partnership with Heart of India Travel (Netherlands) or similar entities to deliver consumer travel packages within the EU. In such cases:
- The EU partner may serve as retail intermediary (B2C front), and Bharatvaas remains the DMC.
- Consumer-facing conditions and guarantees are aligned with EU norms and are specified in the EU partner’s terms.
16. Acceptance
By confirming a booking or entering a written agreement with the Organizer, the Client agrees to these Terms and Conditions in full.
